Please read these Terms carefully before using the ChallanWala platform. By creating an account or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
These Terms of Service constitute a binding agreement between ChallanWala Technologies Pvt. Ltd. ("ChallanWala", "we", "us") and you, the entity or individual accessing or using our platform. If you do not agree to these Terms, do not use the platform.
2. Description of Services
ChallanWala provides a software-as-a-service platform for fleet compliance and challan management. This includes:
- Real-time tracking of traffic challans across all vehicles
- Monitoring of document compliance (fitness certificate, PUC, insurance, permits)
- Driver risk scoring and violation history
- Challan payment processing via integrated payment gateways
- Compliance reports and analytics dashboards
Challan and vehicle data is sourced from the Parivahan portal and state RTO databases. While we strive for accuracy, we do not guarantee the completeness or timeliness of data obtained from third-party government systems.
3. Accounts & Access
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate registration information and notify us promptly of any unauthorised access. You must not share login credentials with unauthorised persons.
4. Subscription & Payments
Subscriptions are billed monthly or annually per vehicle. Prices are in Indian Rupees and are subject to applicable GST.
Payments are processed via PhonePe and Paytm. Invoices are issued at the start of each billing period.
Accounts with overdue payments may have access suspended. Access is reinstated once outstanding dues are settled.
Refund eligibility depends on your plan and billing cycle. Please contact us to discuss your specific situation. Challan payment transaction fees are non-refundable.
5. Acceptable Use
You agree not to:
- Violate any applicable Indian law or regulation
- Attempt to gain unauthorised access to any system or database
- Submit false or fraudulent vehicle or driver information
- Interfere with or disrupt the platform or its infrastructure
- Resell or redistribute the platform without written permission
- Reverse engineer or attempt to extract the source code of the platform
6. Your Data
You retain ownership of your fleet and operational data. By using the platform you grant ChallanWala a limited licence to store and process your data solely to provide the services. On account termination, you may request an export of your data within a reasonable period.
7. Intellectual Property
The ChallanWala platform, including its software, design, and trademarks, is the exclusive property of ChallanWala Technologies Pvt. Ltd. Nothing in these Terms transfers any intellectual property right to you. You may not copy, modify, or create derivative works from the platform without our prior written consent.
8. Limitation of Liability
To the extent permitted by law, ChallanWala is not liable for indirect, incidental, or consequential damages. We are not liable for inaccuracies in data sourced from third-party government systems or for service interruptions caused by events outside our reasonable control.
9. Termination
Either party may terminate the subscription with reasonable notice. ChallanWala may immediately suspend or terminate access if you breach these Terms or engage in fraudulent or illegal activity. On termination, you may request a data export. Provisions relating to payment obligations, intellectual property, and limitation of liability survive termination.
10. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of India.
11. Changes to Terms
We may modify these Terms from time to time. We will notify you of significant changes via email or through an in-platform notice. Continued use of the platform after changes take effect constitutes acceptance.
